Terms of Service

These terms govern your use of NotaryPerfect and our remote online notarization (RON) services. By booking a session or using the site, you agree to them. Please read them carefully.

1. What we do

NotaryPerfect provides remote online notarization by notaries commissioned in Nevada under NRS Chapter 240, performed over live two-way audio-video communication. A notarization verifies your identity, witnesses your signature or affirmation, and applies an electronic notarial certificate and a tamper-evident digital seal.

Notarization confirms whosigned a document. It does not verify the truth, legality, or effect of the document's contents. Our notaries act as public officers of the State of Nevada, not as an agent or advocate of any party.

2. Not legal advice

Our notaries are not acting as attorneysand cannot give legal advice, draft or select documents, explain a document's legal effect, or advise whether you should sign. No attorney-client relationship is formed by using our service. For legal questions, consult your own licensed attorney.

3. Eligibility

  • You must be at least 18 years old and have the legal capacity to sign.
  • You must present a valid, current, government-issued photo ID that passes credential analysis and knowledge-based authentication (KBA).
  • You need a device with a working camera and microphone and a connection that supports continuous audio-video.
  • The notary will be physically located in Nevada during the act. You may join from elsewhere, subject to the conditions in NRS 240.1993 and the law where you are located.

4. Identity verification

By proceeding, you consent to identity proofing: credential analysis of your government ID and dynamic knowledge-based authentication. KBA questions are drawn from public and credit records. These checks are performed through third-party identity-proofing vendors, and you authorize them.

If you cannot be verified, the notarization cannot proceed. This is a legal requirement, not a discretionary choice.

5. Recording and retention

Your session will be recorded in audio and video. Proceeding constitutes your express consent to that recording, which is a mandatory legal record.

Under NRS 240.1995, the recording and the electronic journal are retained for not less than seven (7) years, whether or not the notarial act is completed. The recording may be produced to the Nevada Secretary of State or under court order.

6. Fees and payment

Fees are presented before your session and may include the statutory notarial fee plus a separate technology and convenience fee, itemized at checkout. Because identity verification and recording begin work that we are legally required to retain, fees are non-refundable once identity verification or the session has begun, including where the act is declined or KBA is not passed.

7. Your responsibilities

  • Provide accurate, truthful identity and document information.
  • Ensure your document is complete, with no blank spaces, before the session.
  • Confirm you have the legal right and authority to sign the document.
  • Remain alone or only with parties you have disclosed, with no off-screen coaching or coercion.

You are solely responsible for the content, legality, and intended use of your document.

8. When a notary must decline

A notary may and sometimes must decline to complete a notarization. This is a legal duty, not a service failure. Reasons include:

  • Identity cannot be verified or KBA is not passed.
  • The document is incomplete or contains blanks.
  • The signer appears confused, incapacitated, or does not understand the act.
  • There are signs of coercion, duress, or suspected fraud or illegal purpose.
  • The audio-video connection is inadequate, or the notary has a disqualifying interest.

A declined session may still incur fees and a retained recording, as described above.

9. Document acceptance

We do not guaranteethat any third party, including a county recorder, lender, title company, court, bank, or foreign authority, will accept a remotely notarized document. Acceptance depends on the receiving party's policies and the law of their jurisdiction. Confirm acceptance with the receiving party before booking, especially for out-of-state real property recordings and international use.

10. Disclaimers

The service is provided “as is” and “as available.” We do not warrant uninterrupted connectivity, successful identity verification, or fitness for your particular legal purpose, and we make no warranty that any recipient will accept your document.

11. Limitation of liability

To the maximum extent permitted by law, our aggregate liability is limited to the fees you paid for the session at issue. We are not liable for indirect, incidental, consequential, or special damages, for a third party's rejection of your document, or for technology or transmission failures outside our control.

Nothing in these terms limits a notary's independent statutory duties under Nevada law or your right to file a complaint with the Nevada Secretary of State.

12. Governing law and disputes

These terms are governed by the laws of the State of Nevada, and notarial acts are governed by NRS Chapter 240 and NAC Chapter 240. Any dispute will be resolved in the state or federal courts located in Clark County, Nevada, unless the parties agree otherwise in writing.

13. Changes to these terms

We may update these terms. Changes take effect when posted, with an updated date above. Material changes will be given prominent notice. Continued use after changes means you accept them.
